Accuracy of content

Covey has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only.

Covey take great care with the colours used in the planting packs, plants and containers, patio packs etc. The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.

To the extent permitted by applicable law, Covey disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Covey shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

Damage to your computer

Covey makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Covey shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Password/account security

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. Covey shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

Acknowledgment and acceptance of your order

If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order. Our acceptance of your order will take place upon dispatch of the product(s) ordered. All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available by emailing you.

Delays

Occasionally, the availability of your goods may be delayed. This can be for various reasons such as material shortages, import delays or higher than anticipated demand. We will, of course, make every effort to keep you informed.

Substitution

Planting Packs - Please note that occasionally we may need to substitute certain plants due to availability and the seasonal nature of our product.
We reserve the right to substitute plants of equal quality and value. We will reimburse you for the cost of returning substitute goods that you do not wish to accept.

Guarantee – Products

All of our products are guaranteed. (See Covey guarantee)

Please retain your parcel summary document which is proof of purchase and will validate the date from which your guarantee will start. It is essential to keep your parcel summary document to preserve the guarantee. Please also retain the original packaging in case you need to return the product. In the unlikely event of the item being damaged, please call 01604 822257 and an appropriate method of return will be discussed and arranged.

Upon discussion we will exchange the product for a new one or the nearest equivalent. In the unlikely event of being unable to exchange we will offer a full refund. This guarantee is only valid within the United Kingdom.

Exclusions of liability

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Covey or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Use of this website from outside of mainland UK

Unfortunately we are unable to offer delivery of any of our products to areas outside of mainland UK. (Mainland UK does not include Northern Ireland, Isle of Man, Channel Islands, Scottish Islands and Scilly Islands)

Cancellations, amendments & returns

Under the distance selling regulations you have the legal right to cancel your order within seven working days of receipt of the goods. Where goods are delivered to a third party (e.g. as a gift) you will only be able to exercise this right if you are able to return to us the goods you ordered.

As soon as you realise that you need to change your order please contact us on 01604 822257 and we will help you.

Amendments to orders
If you amend your order, you may find there are changes to your delivery timescale and/or the price you pay for the item (as you’ll be charged the current selling price on the day you amend the order).

Cancellations and returns
If you wish to cancel your order we ask that you advise us at least 48 hours before your planned delivery date and you will receive a full refund. Where the goods have been delivered to you, you may return them for up to 7 working days from the date of delivery in line with the Distance Selling Directive. The packaging may be opened but the goods should not be used. Items should be in a resaleable condition and returned or collection arrangements made promptly at your cost. If collection of an item is required, we will charge you the actual cost of collection (up to £105) of which you will be notified at time of cancellation.

Goods can be returned to Covey Nurseries for a refund. Under the terms of Distance Selling Directive, you as the customer have a duty to care for the product while it is in your possession. If the products are damaged a charge will be made to repair the product to its original condition. In cases where the product cannot be repaired, no refund will be given.

Delivery charges

Deliveries can only be made to mainland UK and are charged as follows:

1. For all orders totaling £100 or over (excluding delivery charges) – delivery is free of charge
2. For all other items where the total value of the order does not reach £100 – charged at £14.95 per delivery.

Payment

When calling our Nursery direct to purchase items not shown or priced on the website, delivery charges will be agreed and quoted separately and may not fall into our internet pricing structure. This also applies when mixing internet products with nursery products. Please ask for further details.

All methods of payment, including credit cards are processed when you place your order and goods will not be dispatched until payment is received.

Delivery Company

Our deliveries are made either a) direct via our Covey delivery vehicles (local deliveries only), b) Palletways, or c) direct from our 3rd party suppliers.

Delivery Arrangements

In all cases, you will be contacted when your order is ready to confirm the delivery date/s and transit method. If there is nobody at home when we deliver, we may where possible, leave your parcel(s) in a safe place or with a neighbour. If we are unable to deliver, the driver will leave a card and return the parcel(s) to the depot.

When ordering Live Plants it is important that you are available within 10 hours of your delivery arriving to unpack and water the plants as appropriate. The Covey guarantee is unable to cover death of plants due improper care.

All of our items will be delivered on one or more pallets and therefore good access is required. If access to your delivery address is restricted, please let us know before placing your order.

If you need to change your delivery for any reason please call us on 01604 822257 Monday to Friday 9am – 5pm.

The goods will be left on the pallet and it is the purchasers responsibility to dispose of the packaging.

Delays

Occasionally, delivery of your order may be delayed or postponed. We will, or course, make every effort to keep you informed and discuss revised delivery timescales.

Special Offer Codes - Free Delivery and other offer order codes remain the property of Covey, are non-transferable and may not be reproduced in any form or used in conjunction with any other offer.

Your statutory rights are not affected by the above terms and conditions
